Terms & Conditions
These Terms and Conditions apply to all quotations, contracts, and installation works carried out by Summerfield Windows & Doors. By accepting a quotation or instructing us to proceed with works, you agree to be bound by these Terms and Conditions.
1. Definitions
“Company”, “we”, “us”, “our” means Summerfield Windows & Doors, a partnership / sole trader business. “Customer”, “you”, “your” means the person(s) or entity entering into an agreement with the Company. “Goods” means made-to-measure windows, doors, frames, glazing units and associated products. “Services” means surveying, supply, installation and related works.

3. Application of These Terms
3.1 These Terms & Conditions apply to all quotations, contracts, sales and installations carried out by the Company.
3.2 No variation shall apply unless agreed in writing by the Company.
4. Quotations & Contract Formation
4.1 All quotations are valid for 30 days unless stated otherwise.
4.2 Quotations are subject to a satisfactory technical survey where required.
4.3 A binding contract is formed once the Customer accepts the quotation in writing or otherwise confirms acceptance, and any required deposit has been paid.
5. Deposits & Payment
5.1 A deposit may be required prior to manufacture or ordering of Goods.
5.2 All Goods are custom-made to order and cannot be resold.
5.3 The balance of the contract price is due upon completion of installation unless otherwise agreed in writing.
5.4 Title to the Goods remains with the Company until full payment has been received.
5.5 The Customer shall not withhold payment for minor snagging or non-material defects which do not prevent normal use of the Goods.
6. Consumer Cancellation Rights (Scotland)
6.1 Where the contract is concluded off‑premises or at a distance, the Customer has a 14‑day cooling‑off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
6.2 This right does not apply to made‑to‑measure or bespoke Goods once manufacture has begun.
6.3 If cancellation occurs before manufacture, the Company may deduct reasonable costs incurred.
7. Survey, Measurements & Site Conditions
7.1 Final measurements will be taken by the Company prior to manufacture.
7.2 The Customer confirms the property is structurally suitable for installation.
7.3 Hidden or latent defects are excluded from the quotation and may incur additional charges subject to approval.
8. Installation
8.1 Installation dates are estimates only.
8.2 The Company shall not be liable for delays caused by weather, supplier issues, or circumstances beyond its control.
8.3 Minor snagging or aftercare items will be completed within a reasonable timeframe subject to labour and material availability.
9. Existing Fittings & Services
The Company is not responsible for damage to existing cables, alarms, aerials, blinds or similar fittings.
10. Damage & Making Good
The Company is not liable for pre‑existing or latent defects or for redecoration beyond reasonable making good directly caused by installation.
11. Guarantees & Warranties
11.1 The Company provides a 10‑year written guarantee on installation workmanship.
11.2 Manufacturer warranties apply to supplied Goods.
11.3 Guarantees exclude fair wear and tear, misuse, neglect, accidental damage, or third‑party interference.
11.4 Guarantees become valid upon receipt of full and final payment.
11.5 Any unauthorised third‑party work will void the guarantee for affected areas.
12. Condensation
No guarantee is given regarding reduction of condensation.
13. Complaints
13.1 Complaints must be made in writing within 14 days of installation or inspection.
13.2 A reasonable proportion of payment may be retained for genuine defects only.
13.3 Access must be provided for inspection and remedial works.
14. Limitation of Liability
14.1 Liability is limited to the value of the contract.
14.2 The Company is not liable for indirect or consequential losses.
14.3 Nothing limits liability for death or personal injury caused by negligence.
15. Governing Law
These Terms are governed by Scots law.
